Okay, here it is. You are in your front yard watering the grass. A nice neighbour's mutt who is a yappy bugger (keeps you up at night) but it is not vicious, has gotten off its leash and has bolted out of its yard thru the gate the postie has left open by accident after running from the aforesaid dog.The kids next door are playing ball and the younger one has just thrown the ball, which hits a part of the fence and deflects into the street. The stupid dog sees the ball sail over the fence and gives chase. Unfortunately a car is driving by and can't avoid the mutt. It is run over and dies instantly. You also saw that the driver may not have been paying attention. You know them to be poor, and having a streak of bad luck. Plus, the nice neighbour who usually likes everyone happens to hate this one person. The lines of site are such that the owner of the dog (was home and) may have been able to see the result of the accident and who "supposedly" was responsible. Who really is responsible for the accident and what do you do/say or do you do nothing at all?

Sounds like it's either the owner's responsibility or nobody's responsbility. The dog shouldn't have gotten out in the first place but you can't blame someone if the dog chases a stray ball into the street and doesn't look both ways before crossing.
Bummer for the owners, but I know when I let my dogs out in the back yard, I make damn sure our gate is closed - and the fence is still standing.

I set up an intricate plot. I put a needle in the dogs arm and a gun in the dogs paw and tell the neighbor that it was the most bizzare thing I have ever seen.

It is the dog's owner to keep his pet secured, by whatever means it takes. It is bad the dog was hit but cars run in the street and pay for them, the dog was out of his place and in the wrong, although being a dumb animal the real blame goes to his owners. As a neighbor if asked what happened I would tell the owner, but if they placed blame, I would tell them where the true blame lies.

I'm definitely with 4X4 on this one.That's their dog & their responsibility.As for you & your roll,I wouldn't say anything unless the luckless folks are going to get their butt kicked in court & I would omit the "not paying attention" thing. I had a similar situation happen to me once (1983).My dog got out of the house & I stood there helpless while the dumb s**t ran right in front of a car,the woman driving was paying attention to the kids in her car & just didn't brake in time.The dog wasn't killed but it cost $300 to get her hip fixed.Initially I was really pissed at the woman but after I had a little time to think about it I realized just who was at fault here. Goos luck with your dilema bud.

it's a dog, the owner should have had it tied up especially if he knew the mailman was an entree to it.
